Terms and Conditions for

Securing Travel Agent Services

through Angela (Angie) Cox, Solasta Travel and all agents

IMPORTANT NOTICE TO CLIENT

DISCLAIMER OF LIABILITY

Angela Cox, Solasta Travel, and any associated agents of Solasta Travel (called the “Company”), is a travel agency and as such acts only as an agent and never as a principal. It is not a supplier, including, but not limited to, all airlines, tour operators, destination management companies, other transporters, providers of accommodation and/or other services, insurers, or dealers in foreign currency. All business which the Company transacts is on behalf of its principals and accordingly any claim which any customer may have arising out of any business transacted by or through the Company will lie against the principal and not against the Company.

The Company may charge a non-refundable Research & Planning Fee prior to any work commencing on your vacation. We often waive this fee for returning clients and referrals. If charged, this fee will be clearly stated in our interactions with you and is payable via Venmo to “@SolastaTravel” or via PayPal to SolastaTravelAgency@gmail.com. By paying this fee (or if the fee is waived), you agree to become our client and we agree to provide luxury level concierge services, which include researching and planning your trip, answering questions before you go, and being available to you for assistance until you return home.

We always do our best to make sure your travel arrangements are satisfactory. But we cannot accept any liability of whatever nature, whether in contract, tort, or otherwise, for the acts, omissions, or default, whether negligent or otherwise, of any Service Providers, over which we have no control.

We do not accept any liability in contract, or otherwise, for any injury, damage, loss, delay, additional expense, dis-satisfaction or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control. We strongly recommend that you take out travel insurance against these risks.

Credit Card authorization and chargebacks: Once you have begun working with the Company, or if you have provided your credit card information, in any form, to the Company for payment on your behalf, or in any way requested or used the services of the Company, you acknowledge and accept the following: In lieu of your credit card imprint, you authorize the Company to use the credit card provided to pay for the agreed upon travel services. You fully acknowledge that any credit card chargebacks are your responsibility and NOT the responsibility of the Company.

The Company act solely as the agent and make no oral or written warranty, expressed or implied. You understand that in the event of a cancellation, the travel supplier may assess penalty charges that are your responsibility. You will NOT hold The Company or any of its agents liable for these charges.

You acknowledge that this agreement will remain in force until such time as canceled by you in writing. You also acknowledge that if the card used is canceled or an authorization for the charge is declined, you will pay any amounts outstanding for the services provided. The Company is NOT responsible for any outstanding balances or chargebacks your credit card company or suppliers may charge.

In entering into this transaction, providing your credit card details, or confirming a booking, you acknowledge that:

● The Company acts as a travel agent only;

● The Company’s obligation to you is to make travel bookings on your behalf and to arrange relevant contracts between you and service providers;

● Once the Company has made your travel arrangements for you, it has provided you fully with the service which it is obliged to supply and has no further legal obligations;

● If for any reason any service provider is unable to provide the services for which you have contracted, your remedy lies against that service provider and not against the Company—Of course we will help all we can!

● In the event that payment has been made by credit card, you agree that you will not seek to chargeback or recover your payment or any other losses from the Company and acknowledge it is solely your responsibility.

Documentation: It is your personal responsibility to ensure that you have valid documentation, including but not limited to a valid passport and required visas or entry documents, which meet the requirements of immigration and other government authorities at all destinations. It is your responsibility to ensure you understand the requirements around other special restrictions such as those travelers with felonies or other legal concerns, children traveling alone or without 1 or all legal guardians, and other issues. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of such authorities will be your sole responsibility.

It should be noted that all documents issued to travelers are non-transferable. Such documents may include, but are not limited to, airline tickets, hotel vouchers, tour vouchers, or any other document used to confirm an arrangement with a Service Provider. Such documents may also be subject to conditions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation or amendment fees. It is your responsibility to familiarize yourself with these conditions.

We strongly recommend travel insurance for all travelers, particularly considering the majority of airlines and tour operators may have high cancellation/date change penalties. Please check with us for further details, but note that we are not insurance experts and accordingly do not make any warranty concerning the adequacy or extent of any coverage under any policy which we sell. Customers are advised to read and become acquainted with the policy documents.

Health & Safety Notice: As the traveler, you have requested that your travel agent, the Company, book travel arrangements on your behalf. Due to the COVID-19 pandemic or any situation going forward, you acknowledge and fully understand that these travel arrangements may be interrupted or cancelled by the associated travel supplier, a government entity, or another third party outside of the Agency's control for reasons that are unforeseeable at this time. You also understand and acknowledge that travel involves the risk of a variety of hazards to health and/or safety, including but not limited to, injury, illness, disease, epidemics, and/or pandemics. It is fully your responsibility to take personal safety precautions while traveling. You expressly understand and agree to assume all such risks associated with travel whether or not specified herein. You further understand and acknowledge that the Agency / Company has no control over the associated supplier's policies which, in addition to applicable law, will solely govern any cancellation, rebooking, and refund related to these travel arrangements.

You also understand and acknowledge that the purchase of travel insurance (also called travel protection) is highly recommended and that coverage for circumstances such as these depends on the specific policy you purchase. Should you elect to obtain coverage, the travel insurance policy obtained to cover these travel arrangements will dictate any coverage for financial loss resulting from these circumstances. By proceeding with our services, in any form, you acknowledge and agree to these Terms and Conditions.
